These Terms of Use (“Terms”) govern your access to and use of senseofthai.com and related webpages, digital services, reservation links, forms, marketing communications, and other online features provided by Sense of Thai and its affiliated restaurant operating entities (collectively, “Sense of Thai,” “we,” “us,” or “our”).
By accessing or using our website or related services, you agree to these Terms and our Privacy Policy. If you do not agree with these Terms, please do not use the website or related services.
1. SENSE OF THAI AND OPERATING ENTITIES
Sense of Thai is a restaurant brand with locations that may be owned and operated by separate affiliated legal entities. The entity responsible for a particular restaurant, transaction, promotion, or communication may therefore depend on the Sense of Thai location with which you interact.
Where applicable, location-specific terms, disclosures, offers, or communications may identify the legal entity operating that location.
References in these Terms to “Sense of Thai,” “we,” “us,” or “our” refer, as applicable, to the Sense of Thai operating entity responsible for the website, restaurant location, service, transaction, or communication at issue.
2. USE OF THE WEBSITE
The Sense of Thai website provides information about our restaurants, menus, locations, events, promotions, reservations, and related services.
You may use the website only for lawful purposes and in accordance with these Terms. You agree not to use the website in any manner that could damage, disable, overburden, impair, or interfere with the website or another person’s use of it.
We may modify, suspend, discontinue, or restrict access to any portion of the website at any time without notice, subject to applicable law.
3. RESERVATIONS AND THIRD-PARTY SERVICES
Sense of Thai may use third-party platforms, including reservation, ordering, payment, delivery, marketing, and other service providers, to provide certain features or services.
When you access or use a third-party service through our website, your use of that service may also be governed by the third party’s terms, privacy policy, and other applicable policies.
Restaurant reservations may be processed through Resy or another reservation provider. Availability, reservation modifications, cancellations, deposits, fees, and other reservation conditions may be subject to the applicable restaurant’s policies and the terms of the reservation provider.
Sense of Thai is not responsible for the availability, operation, security, accuracy, or practices of independent third-party services.
4. MENUS, PRICING, EVENTS, AND PROMOTIONS
Menus, prices, operating hours, event details, promotions, availability, and other information displayed on the website are provided for informational purposes and may change without notice.
Menu items and ingredients may vary by location or availability. Images are illustrative and may not represent the exact presentation of a menu item.
Promotions, special events, offers, and experiences may be subject to additional terms, eligibility requirements, availability, reservation requirements, expiration dates, or location-specific restrictions disclosed with the applicable offer.
We reserve the right to correct errors or inaccuracies and to modify or discontinue offerings subject to applicable law.

8. EMAIL MARKETING
You may choose to receive promotional email communications from Sense of Thai or a particular Sense of Thai location.
You may unsubscribe from marketing emails at any time by using the unsubscribe link provided in the message or by contacting us.
Unsubscribing from promotional email does not necessarily prevent us from sending non-marketing communications related to reservations, transactions, inquiries, or other services you request.
Email marketing consent is separate from SMS marketing consent.
9. SMS MARKETING
Certain Sense of Thai locations may offer optional marketing text-message programs. The entity operating the applicable location will be identified in the SMS signup experience or related disclosure.
Sense of Thai Bethesda SMS Program
The Sense of Thai Bethesda marketing text-message program is operated by SP Westbard Inc. d/b/a Sense of Thai Bethesda.
By providing your mobile number through an SMS signup process and affirmatively opting in, you consent to receive recurring promotional and marketing text messages from Sense of Thai Bethesda at the mobile number provided. Messages may include restaurant news, events, special experiences, offers, reminders, and related updates and may be sent using automated technology.
Consent is not a condition of purchasing goods or services. Email consent and SMS consent are separate.
Message Frequency. Message frequency varies based on promotions, events, and restaurant activity.
Message and Data Rates. Message and data rates may apply. Your wireless carrier may charge fees according to your mobile plan. Sense of Thai is not responsible for carrier charges.
Opt Out. You may opt out at any time by replying STOP to a marketing text. After you opt out, you may receive a confirmation message. Your opt-out applies to the applicable Sense of Thai Bethesda SMS program unless otherwise stated.

Mobile Number Eligibility. By opting in, you represent that you are the subscriber or customary user of the mobile number provided and are authorized to consent to receive messages at that number. If you change or relinquish your mobile number, please opt out or notify us so that we can update our records.
Delivery and Availability. Message delivery is subject to effective transmission by your wireless carrier and is not guaranteed. The program may not be available on all carriers, devices, or locations. We may modify, suspend, or discontinue the program subject to applicable law.
10. PRIVACY

For SMS programs, mobile information and SMS opt-in consent will not be sold or shared with third parties or affiliates for their own marketing or promotional purposes. Sense of Thai makes no warranty that the website will be uninterrupted, error-free, secure, or free of harmful components, or that information available through the website will always be complete, accurate, or current.
Nothing in this section limits any warranty or right that cannot lawfully be excluded.
13. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, Sense of Thai and its affiliated entities, owners, officers, employees, agents, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of, or inability to use, the website or related services.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
14. INDEMNIFICATION
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Sense of Thai and its affiliated entities, owners, officers, employees, agents, and service providers from claims, liabilities, damages, losses, and expenses arising from your violation of these Terms, misuse of the website, or infringement of another person’s rights.
15. COPYRIGHT AND INTELLECTUAL PROPERTY COMPLAINTS
If you believe material appearing on the Sense of Thai website infringes your copyright or other intellectual property rights, please contact us with sufficient information to identify the work at issue, the allegedly infringing material, your contact information, and the basis for your claim.
We may remove or restrict access to content where appropriate and in accordance with applicable law.
16. GOVERNING LAW AND DISPUTES
